Trip Terms & Conditions

By booking a travel program with Alluring Americas Inc. (operating as Alluring Americas), a U.S. company incorporated and registered in the State of Florida and licensed as a Florida Seller of Travel (#ST36939), travelers agree to be bound by these Trip Terms & Conditions. Any payment made to Alluring Americas constitutes acceptance of these Trip Terms & Conditions.

For travel programs that include a charter vessel component, the Charter Agreement Terms & Conditions shall apply in addition to these Trip Terms & Conditions.

DEPOSIT & PAYMENT TERMS

1. Deposit Requirement:

A non-refundable deposit of 30% of the total trip cost, covering land-only arrangements or land trips with cruise components, is required per traveler at the time of booking for a trip with Alluring Americas Inc. (operating as Alluring Americas).

2. Additional Deposits:

Certain hotels, cruises and trip-related suppliers may require additional non-refundable deposits for travel during peak periods, including but not limited to Carnival, Festive Season (Dec 18 – Jan 4) and special events in the destination country.

3. Airfare Payments:

If airfare is quoted separately from the land-only rate, full payment (100%) of the airfare is required at the time of booking to issue tickets. Airfares are always subject to change until tickets are issued.

4. Final Payment Deadline:
  • For standard travel periods, final payment is due no later than 91 days before the trip start date.
  • For peak travel periods, including Carnival, Festive Season (Dec 18 – Jan 4), and special events, final payment is due no later than 121 days before the trip start date.

By making a payment, travelers acknowledge and agree to these deposit and payment terms.

 

Accepted Payment Methods:

Alluring Americas accepts payments via American Express, Visa, MasterCard, Discover credit/debit cards, and Bank ACH/Wire Transactions.

 

CANCELLATION AND REFUND POLICY

By booking a trip with Alluring Americas Inc. (operating as Alluring Americas), travelers acknowledge and agree to the following cancellation terms.

1. Cancellation Fees and Administrative Costs

The cancellation fee for an Alluring Americas trip is not limited to penalties imposed by travel partners, including hotels, cruise operators, and other trip-related suppliers. It also reflects administrative costs associated with consultation, itinerary development, reservation management, securing confirmations, and financial and operational resources dedicated to trip planning. These efforts require significant time and coordination; therefore, the cancellation fee accounts for both supplier-imposed charges and the professional services rendered throughout the booking process.

2. Cancellation Policy for Land-Only Trips (Excluding an Amazon, Galápagos, Patagonia, Coastal Ecuador, or Coastal Costa Rica Cruise Component) during standard travel periods
  • 91 or more days prior to departure: Deposits received per traveler are non-refundable.
  • 90-61 days prior to departure: 50% of total trip cost per traveler is non-refundable.
  • 60-0 days prior to departure: 100% of total trip cost per traveler is non-refundable.
  • Non-refundable charges are not eligible for travel credit, future use, or transfer to any other trip.
3. Cancellation Policy for Trips Including an Amazon, Galápagos, Patagonia, Coastal Ecuador, or Coastal Costa Rica Cruise Component during standard travel periods
  • 91 or more days prior to departure: Deposits received per traveler are non-refundable.
  • 90-0 days prior to departure: 100% of total trip cost per traveler is non-refundable.
  • Non-refundable charges are not eligible for travel credit, future use, or transfer to any other trip.
4. Cancellation Policy for Peak Travel Periods

Applies to Carnival, Festive Season (Dec 18 – Jan 4), and special events in the destination country.

  • 121 or more days prior to departure: Deposits received per traveler are non-refundable.
  • 120-91 days prior to departure: 50% of total trip cost per traveler is non-refundable.
  • 90-0 days prior to departure: 100% of total trip cost per traveler is non-refundable.
  • Non-refundable charges are not eligible for travel credit, future use, or transfer to any other trip.
5. Airline Reservation Cancellations and Changes
  • Before first flight departure:
    • Once airline tickets are issued, cancellation is subject to an administrative processing fee of 10% of the airfare (minimum $100, maximum $350) per ticket, in addition to any cancellation penalties assessed by the airline as governed by the fare rules.
    • For non-refundable fares, the administrative processing fee will not be assessed.
  • After flight departure:
    • Any remaining unused segments are non-refundable.
  • Changes to airline reservations:
    • Once airline tickets are issued, flight and date changes on the same route are not subject to an administrative processing fee. However, any airline-imposed change fees and fare differences, as governed by the fare rules, will apply. For all other changes, including modifications to the routing, a $100 administrative processing fee per ticket will be charged in addition to any airline-imposed change fees and fare differences as determined by the fare rules.

By making a payment to Alluring Americas, travelers confirm their acceptance of these cancellation and refund policies.

 

6. Refund Policy for Trip Cancellations During Travel
  1. Voluntary Cancellations:
    If a traveler voluntarily cancels any portion of their trip after departure, no refunds will be issued for unused services, including but not limited to accommodations, meals, flights, ground, rail or water transportation, guided tours, excursions, activities, entrance fees, national park fees or any government levies.
  2. Involuntary Cancellations:
    If a traveler is required to cancel any portion of their trip due to circumstances beyond their control, any refunds for unused services shall be issued solely at the discretion of Alluring Americas. Any adjustments will be based on the actual cost of the service involved, not on a per diem basis.
  3. Refund Requests:
    • All refund claims must be submitted in writing to Alluring Americas within 31 days of the trip’s termination.
    • All claims are subject to verification by our in-destination travel partners, including hotels, cruise operators, and other trip-related suppliers.
    • Requests received after 31 days from trip termination will not be considered.

By booking a trip with Alluring Americas, travelers acknowledge and accept this refund policy.

 

CREDIT/DEBIT CARD CHARGEBACK POLICY

By making a credit or debit card payment to Alluring Americas Inc. (operating as Alluring Americas), the traveler acknowledges and agrees not to initiate a chargeback (also referred to as a charge dispute) for any authorized payment made in accordance with the agreed-upon itinerary and payment terms. Any chargeback deemed fraudulent, baseless, or in violation of these Trip Terms & Conditions will be contested to the fullest extent, and Alluring Americas reserves the right to recover the disputed amount, along with any associated fees, including legal fees, collection agency costs, and administrative expenses. Before initiating a chargeback, the traveler must contact Alluring Americas in writing at accounting@alluringamericas.com within 10 business days of any billing discrepancy to seek resolution. If a refund or adjustment is warranted, it will be processed in accordance with Alluring Americas’ cancellation and refund policies. The traveler will be responsible for reimbursing any losses incurred due to an unwarranted chargeback.

By proceeding with a booking and making payment, the traveler affirms that they have read, understood, and agreed to this chargeback policy, and any violations may result in legal action or collection proceedings.

 

TRAVEL INSURANCE

Alluring Americas strongly recommends that travelers purchase comprehensive Travel Insurance to protect against trip cancellation penalties, non-refundable charges, travel delays, baggage loss, medical emergencies, and evacuation. While you are free to choose any provider, we have partnered with Trawick International®, a trusted leader in travel insurance, to offer plans that cover pre-paid, non-refundable expenses in case of trip cancellation for a covered reason. Additionally, optional benefits such as Cancel for Any Reason (CFAR) and Interruption for Any Reason (IFAR) provide extra flexibility. Without travel insurance, travelers acknowledge and accept full responsibility for any financial losses and will be subject to the cancellation fees outlined in these Trip Terms & Conditions.

 

TRIP RATES, WHAT IS INCLUDED & NOT INCLUDED

  • Pricing & Currency:
    Alluring Americas trip rates are quoted in U.S. Dollars (USD). Unless otherwise specified, all travelers within a reservation are assumed to be traveling together for all services. Changes in the number of travelers or modifications to arrival and departure arrangements requiring additional transfers will result in a rate adjustment.
  • Confidentiality of Pricing:
    Alluring Americas operates as a tour operator, not a travel agency. The pricing for our travel packages include confidential contractual rates for accommodations, tours, experiences and activities, transfers, guides, transportation fees, and other operational costs. Due to contractual obligations, we are unable to provide itemized breakdowns of our trip package rates to travelers or travel agencies.
  • What is Included in Trip Rates:
    Trip rates include administrative costs associated with consultation, itinerary development, reservation management, confirmations, and operational expenses. Unless otherwise stated in the itinerary, trip rates also include:

    • Prepaid hotel or cruise accommodations (booked through Alluring Americas).
    • Hotel taxes, unless noted otherwise.
    • Meals as indicated in the itinerary.
    • Guided excursions, including entrance fees (unless noted otherwise).
    • Domestic or regional flights (unless noted otherwise).
    • Ground transportation via vehicle, rail, or water (as applicable).
    • Transfers between hotels, airports, or cruise ports (as applicable).
    • 24/7 Emergency Assistance during the trip.
  • What is Not Included in Trip Rates:
    The following items are not included unless specifically stated in the itinerary:

    • Travel Insurance (unless purchased through Alluring Americas).
    • Airfares (unless noted otherwise).
    • Airline excess baggage fees.
    • Hotel occupancy taxes or levies that must be paid directly by the guest.
    • Gratuities of any kind.
    • Meals not specified in the itinerary.
    • Beverages unless explicitly included in the itinerary.
    • Meals for guides if invited to dine with travelers.
    • Sightseeing or optional excursions not included in the itinerary.
    • Costs for passports, visas, national park fees, or border fees that cannot be prepaid.
    • Personal expenses, including laundry, communication charges, internet access, and hotel incidentals.

 

TRIP REVISION

Trip revision or rebooking requests must be submitted in writing to Alluring Americas no later than 91 days prior to the trip start date and are only applicable for trips during standard travel periods. This policy does not apply to trips scheduled during peak travel periods including but not limited to Carnival, Festive Season (Dec 18 – Jan 4), and special events in the destination country. Approval of any revision or rebooking is subject to availability and supplier policies. An administrative processing fee of $350 per traveler will apply, along with any cancellation fees assessed on the existing confirmed trip. Any additional costs resulting from modifications to accommodations, itinerary, or services will be the sole responsibility of the traveler. Alluring Americas reserves the right to deny any rebooking request at its sole discretion.

 

SPECIAL REQUESTS

Special requests, including adjoining or connecting rooms and bedding preferences, must be communicated at the time of booking, while dietary needs must be provided no later than 61 days before the trip start date. While Alluring Americas will make every effort to accommodate these requests, they cannot be guaranteed. Airline seat assignment requests are subject to the airline’s policies and availability, and some fare classes do not permit advance seat selection. Additionally, airlines may change assigned seats due to equipment or operational factors, even after confirmation. As such, Alluring Americas cannot guarantee any specific seat assignment on flights.

 

CHILD POLICY

Certain hotels, cruise operators, and other trip-related suppliers impose minimum age requirements, which will be disclosed before booking. All travelers under 18 years of age must be accompanied by an adult, and some accommodations may require that children below a certain age share a room with an adult.

A parent or guardian traveling alone with a minor should carry documentation proving their relationship to the child (e.g., birth certificate) and may be required to provide evidence of parental consent to travel (e.g., notarized consent letter). Travelers accompanying children who are not their own are strongly advised to carry documentation proving they have permission to travel with the child. It is the traveler’s sole responsibility to verify and obtain all necessary documentation by consulting the relevant government authorities. Alluring Americas assumes no responsibility for denied entry or travel disruptions resulting from noncompliance with any country’s requirements.

 

TRAVEL DOCUMENTS

Each traveler is solely responsible for obtaining and carrying a valid passport with an expiration date of at least six (6) months beyond the date of entry into any destination country, along with any required visas, a round-trip or onward airline ticket, and sufficient funds for the duration of their stay. Alluring Americas assumes no responsibility for a traveler’s failure to obtain necessary travel documents, denial of entry, or any associated costs or losses.

 

BAGGAGE

Baggage weight and size restrictions vary by airline, class of service, train, and cruise vessel, and travelers are solely responsible for complying with these limitations. Any excess baggage fees incurred are the responsibility of the traveler. All baggage and personal belongings are transported at the traveler’s own risk, and Alluring Americas assumes no liability for lost, stolen, or damaged baggage at any point during the travel program.

 

HEALTH AND MEDICAL FITNESS

All travelers must be in good general health to fully enjoy a trip with Alluring Americas. Travelers with medical conditions must disclose such conditions to Alluring Americas in writing no later than 91 days prior to departure. Alluring Americas and its affiliated service providers reserve the right to disqualify any traveler at any time if, in their sole discretion, the traveler is deemed medically unfit for travel. Alluring Americas and its affiliates assume no liability for the provision of medical care or special medical accommodations. Information regarding any required vaccinations for a destination will be provided upon request and during trip consultations; however, travelers are strongly advised to consult their medical provider, local health authorities, or the CDC for specific medical requirements or recommendations based on their personal medical history.

Pregnant travelers must notify Alluring Americas at the time of booking and provide a physician’s statement confirming their fitness to travel. Failure to disclose pregnancy may result in cancellation penalties as outlined in the cancellation policy. Trip insurance typically does not cover normal pregnancy. Travelers who will be beyond their fifth month of pregnancy at the start of the trip will not be accepted. Pregnant travelers assume full risk for travel, and Alluring Americas assumes no responsibility for providing medical care or special accommodations.

 

COMMUNICABLE AND INFECTIOUS DISEASE POLICY

For the purposes of these Trip Terms & Conditions, a “Communicable Disease” refers to any illness caused by bacteria, viruses, parasites, or fungi that can be transmitted from one person to another. An “Infectious Disease” is any illness caused by such microorganisms that enter the body, multiply, and result in infection.

By booking a trip with Alluring Americas, travelers acknowledge that there is an inherent risk of exposure to Communicable and Infectious Diseases (Viral, Bacterial, Parasitic, Food and Waterborne Diseases), including their variants, and any future mutations thereof. Some of these diseases can be highly contagious and may result in severe illness or death. No precautionary measures can completely eliminate the risk of exposure. The Centers for Disease Control and Prevention (CDC) and other Public Health Authorities have determined that older adults and individuals with underlying medical conditions are at greater risk of severe illness or complications from certain infectious diseases. Travelers also acknowledge that they may expose others to Communicable or Infectious Diseases, even if they are asymptomatic.

By participating in a trip with Alluring Americas, travelers voluntarily assume all risks associated with exposure to Communicable or Infectious Diseases, including the potential for illness, injury, or death. Travelers understand that participation in a trip is entirely voluntary and agree that it is their sole responsibility to assess their individual risk. Alluring Americas strongly advises all travelers to consult a medical professional before booking and to consider their personal health status and any pre-existing conditions when making travel decisions.

Travelers further agree to comply with all public health regulations, mandates, and safety protocols issued by Alluring Americas and Public Health Authorities, which may include, but are not limited to: (a) mandatory testing before, during, or after travel; (b) submission to health screenings and symptom checks; (c) potential denial of participation if exhibiting symptoms of illness or known exposure to a Communicable Disease, at the sole discretion of Alluring Americas; (d) participation in contact tracing efforts; (e) compliance with isolation or quarantine requirements; (f) adherence to mask mandates and other protective measures as required by public health guidelines; and (g) compliance with physical distancing measures when applicable. Travelers acknowledge that public health protocols are subject to change at any time without prior notice, and it is their sole responsibility to stay informed and comply with the latest requirements in their destination(s).

Additionally, travelers are responsible for staying informed of government-issued travel advisories and warnings, including those issued by the U.S. Department of State and other government agencies. If a traveler chooses to proceed with their trip despite an active travel warning, they assume all associated risks, including the risk of personal injury, illness, death, or property damage. Travelers are strongly encouraged to review the latest health and safety advisories before booking and departing by visiting the CDC and the U.S. State Department websites.

By booking a trip with Alluring Americas, travelers acknowledge and agree to accept these terms, assume full responsibility for their participation, and waive any claims related to exposure to Communicable or Infectious Diseases.

 

PHOTOGRAPHY DURING TRAVEL

Alluring Americas and its affiliated companies reserve the right to capture photographs and videos of travelers during any portion of a trip for promotional, advertising, or other business purposes. By booking a trip with Alluring Americas, travelers acknowledge and agree that Alluring Americas is the sole owner of such photographs and videos and may use their image, likeness, voice, statements, or recordings for promotional use in any media format, both during and after the trip. Travelers who do not wish to have their image used must inform their guide or escort at the beginning of the trip and submit a written request to their Alluring Americas travel consultant within 31 days after the trip’s conclusion. Failure to provide timely notice constitutes irrevocable consent to Alluring Americas’ unrestricted use of such images. This agreement extends to all travelers, including minors, for whom the primary traveler grants permission on their behalf.

 

AIR TRANSPORTATION

Alluring Americas can assist travelers with international and required internal (domestic or regional) flight reservations in any requested class of service, except for Basic Economy or equivalent fare types, due to their restrictive nature. Certain trips require internal flights to be purchased through Alluring Americas. We do not facilitate mileage upgrades or mileage redemption requests. Airfares are subject to change until tickets are issued, and all reservations require traveler names exactly as they appear on their passports. Flight confirmations are subject to availability and cannot be finalized until a passport copy is provided to Alluring Americas.

For flights not booked through Alluring Americas, we assume no responsibility for errors or discrepancies in third-party airfare bookings. It is solely the traveler’s responsibility to ensure that their arrival and departure flights align with the designated trip start and end cities.

Alluring Americas acts solely as an independent intermediary for air travel arrangements and does not own, manage, control, or operate any airline. By purchasing an airline ticket, whether through Alluring Americas or another entity, travelers enter into a direct contract with the airline, not Alluring Americas. All airline-related matters, including seat assignments, name changes, schedule changes, insufficient travel documentation, flight delays, cancellations, or any other modifications, are the sole responsibility of the airline. Any changes or cancellations made to airline reservations before or after travel begins are subject to the airline’s change and cancellation policies, including all associated fees. Airlines operate as independent contractors, and Alluring Americas assumes no liability for any act, omission, or event occurring while travelers are not on board the aircraft. International air carriers are governed by applicable international air conventions, which limit their liability. The terms and conditions printed on airline tickets constitute the sole contract between the traveler and the airline, and Alluring Americas shall not be held liable for any claims arising from air travel services.

 

RESPONSIBILITY & LIABILITY STATEMENT

Alluring Americas, including its employees, officers, directors, agents, affiliates, and assigns, acts solely as an independent intermediary for the provision of travel services and does not own, manage, control, or operate any accommodations, transportation providers (airlines, trains, vessels, motor vehicles), restaurants, ground handling services, or other travel-related entities. All such service providers are independent contractors, and as a result, Alluring Americas assumes no liability for any negligent, willful, or otherwise improper acts or omissions of these third-party suppliers or any unrelated third parties.

By booking a trip with Alluring Americas, travelers acknowledge and agree that Alluring Americas is not responsible for any personal injury, financial loss, illness, disease, death, property damage, inconvenience, or delay arising from, but not limited to, acts of God or force majeure, epidemics, pandemics, war, civil unrest, strikes, labor disputes, criminal or terrorist activity, mechanical failures, weather conditions, overbooked accommodations, transportation failures, or failure of any provider to honor its contractual obligations. Furthermore, adventure travel involves inherent risks, including but not limited to accidents, exposure to wildlife, high-altitude treks, water-based activities, and remote locations far from medical facilities. Travelers voluntarily assume all risks associated with these activities and acknowledge that medical care and evacuation may be delayed or unavailable.

If a traveler voluntarily participates in high-risk activities, including but not limited to hot air ballooning, scuba diving, zip-lining, whitewater rafting, horseback riding, wildlife tracking, hiking, or any other physically demanding activity, they accept full responsibility for their participation and release Alluring Americas from all liability for any illness, injury, death, or property damage arising from such activities, including those resulting from negligence. Travelers further agree not to file claims against Alluring Americas for any loss or damage related to their participation in such activities, including cancellation, injury, or death.

Force Majeure & Travel Disruptions: Alluring Americas is not liable for any failure to perform its contractual obligations when such failure results from force majeure events, including but not limited to war, terrorism, riots, natural disasters, health emergencies, government-imposed travel restrictions, industrial actions, airline schedule changes, or other circumstances beyond its control. In the event of trip cancellations, modifications, or disruptions due to such events, Alluring Americas shall not be responsible for additional costs incurred by the traveler, including but not limited to non-refundable airfare, insurance, visas, and other travel arrangements.

Travel Documents & Compliance: Travelers are solely responsible for ensuring that they possess valid passports, visas, entry permits, and any required vaccinations for all destinations on their itinerary. Alluring Americas assumes no responsibility for denial of entry, deportation, or additional costs due to non-compliance with a country’s travel regulations. It is the traveler’s responsibility to review the latest travel advisories by consulting official government sources such as the U.S. Department of State and the Centers for Disease Control and Prevention. Travelers who choose to proceed with travel despite official advisories assume all associated risks, including personal injury, illness, or property loss.

Changes & Cancellations by Alluring Americas: Alluring Americas reserves the right to modify, reschedule, or cancel any trip, in whole or in part, due to unforeseen circumstances. In the event of cancellation prior to departure (except due to force majeure), travelers may receive a refund subject to supplier policies and non-refundable deposits. Alluring Americas also reserves the right to substitute accommodations, transportation, or services if required and to decline to accept or retain any traveler whose behavior is deemed disruptive to the trip or detrimental to the safety and experience of other participants. Any costs incurred due to a traveler’s removal from the trip shall be the sole responsibility of the traveler.

Arbitration Agreement: Any dispute, claim, or controversy arising out of or relating to these Trip Terms & Conditions, the travel itinerary, or any information regarding an Alluring Americas trip or service shall be resolved exclusively through binding arbitration in Orlando or Winter Park, Florida, in accordance with the rules of the American Arbitration Association. Parties may appear by telephone or video conference. Each party shall bear its own fees, costs, and expenses, as well as an equal share of any arbitrator and administrative fees.

By booking a trip with Alluring Americas, travelers confirm that they have read, understood, and accepted these Trip Terms & Conditions, including the assumption of risks, waiver of liability, and personal responsibility for compliance with travel requirements.
